1. Acceptance of These Terms

These Terms of Use (the “Terms”) are a binding agreement between you and Broadcast Media Inc, a Wyoming corporation doing business as MyHomeSale.net (“MyHomeSale,” “we,” “us,” or “our”), governing your access to and use of https://myhomesale.net (the “Site”) and all content, tools, and services made available on it (together, the “Service”). By accessing or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. Our text messaging program is additionally governed by our Messaging Terms, which are incorporated into these Terms for subscribers.

2. Eligibility

The Service is intended for individuals who are at least 18 years old and located in the United States. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

3. Educational Information Only — No Advice, No Brokerage

MyHomeSale is an independent publisher of educational information about selling a home. We are not a real-estate broker, real-estate agent, lender, mortgage broker, title company, escrow agent, attorney, accountant, or financial, legal, tax, or investment adviser, and we are not licensed to provide any of those services in any jurisdiction. Nothing on the Service is, or should be treated as, professional advice of any kind, and nothing on the Service is an offer to buy, sell, list, or market real property.

  • No agency, brokerage, fiduciary, attorney-client, adviser-client, or other professional or client relationship is created by your use of the Service, by contacting us, or by subscribing to our communications.
  • Content is general in nature; real-estate practices, laws, taxes, and market conditions vary significantly by state, locality, and time, and content may become outdated.
  • Calculators and tools (including our net-proceeds estimator) produce rough, illustrative estimates only and are not appraisals, quotes, or predictions.
  • Before acting on anything you read here, consult qualified, licensed professionals — such as a real-estate agent or broker, attorney, or tax adviser — who can evaluate your specific situation.

4. Acceptable Use

You agree not to:

  • Use the Service in any way that violates applicable law or regulation;
  • Attempt to gain unauthorized access to the Service, its servers, or any connected systems, or probe, scan, or test their vulnerability;
  • Interfere with or disrupt the Service, including by overloading, flooding, or introducing malicious code;
  • Scrape, harvest, or bulk-collect content or data from the Service by automated means, except by well-behaved search-engine crawlers honoring our robots directives;
  • Submit false, misleading, or unlawful information through our forms, or impersonate any person or entity;
  • Enroll any phone number in our text program other than your own; or
  • Reproduce, resell, or commercially exploit the Service except as expressly permitted in Section 5.

5. Intellectual Property and Limited License

The Service and all of its content — including text, guides, checklists, graphics, logos, the “MyHomeSale” name and wordmark, page designs, tools, and underlying code — are owned by Broadcast Media Inc or its licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Service and to view, print, or save individual pages for your own personal, non-commercial use in connection with selling your home. All other rights are reserved. You may not remove or alter copyright or trademark notices, use our name or marks without prior written permission, or republish substantial portions of the Service. Brief quotations with attribution and a link to the source page are welcome.

6. Third-Party Links and Resources

The Service may link to third-party websites, tools, or resources. These links are provided for convenience only; we do not control third-party sites and are not responsible for their content, accuracy, products, services, or privacy practices. A link is not an endorsement. Your dealings with any third party are solely between you and that party. Our Disclaimer describes how we handle any advertising or affiliate relationships.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT CONTENT IS ACCURATE, COMPLETE, CURRENT, OR APPLICABLE TO YOUR SITUATION; OR THAT ANY ESTIMATE, FIGURE, OR RANGE ON THE SERVICE WILL MATCH YOUR ACTUAL EXPERIENCE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MYHOMESALE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY (INCLUDING ANY LOSS RELATING TO THE SALE, PRICING, OR MARKETING OF REAL PROPERTY), ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY, WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. THE LIMITATIONS IN THIS SECTION ARE A FUNDAMENTAL PART OF THE BARGAIN BETWEEN YOU AND US AND APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

9. Indemnification

You agree to indemnify, defend, and hold harmless MyHomeSale and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Service, your violation of applicable law, or your violation of the rights of any third party. We may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with our defense.

10. Governing Law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, and by applicable U.S. federal law, including the Federal Arbitration Act with respect to Section 11.

11. Dispute Resolution: Binding Arbitration and Class-Action Waiver

Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court.

11.1 Informal Resolution First

Before starting arbitration, you agree to first contact us at [email protected] describing the dispute and giving us 30 days to try to resolve it informally. Most concerns can be resolved this way.

11.2 Binding Individual Arbitration

Except as provided in Sections 11.4 and 11.5, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitrator’s award will be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitration will be conducted in English; hearings, if any, may be held by videoconference or, if an in-person hearing is required, in the county where you live or another mutually agreed location. Payment of filing, administration, and arbitrator fees will be governed by the AAA’s consumer rules. The arbitrator has exclusive authority to resolve disputes about the interpretation, applicability, or enforceability of this arbitration agreement, except that a court decides the enforceability of the class-action waiver in Section 11.3.

11.3 Class-Action and Jury-Trial Waiver

YOU AND MYHOMESALE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. Claims may be brought only in an individual capacity, and the arbitrator may not consolidate more than one person’s claims. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the remainder of this Section 11 remains in effect.

11.4 Small-Claims Carve-Out

Either party may bring an individual claim in small-claims court in a court of competent jurisdiction instead of arbitration, so long as the claim remains in that court and is pursued only on an individual basis. Either party may also seek injunctive or other equitable relief in court to protect intellectual property rights.

11.5 30-Day Right to Opt Out

You may opt out of this arbitration agreement (Sections 11.2 and 11.3) by sending written notice within 30 days of the date you first accept these Terms, either by email to [email protected] with the subject “Arbitration Opt-Out,” or by mail to Broadcast Media Inc dba MyHomeSale.net, 1712 Pioneer Ave., Ste 500, Cheyenne, WY 82001. Your notice must include your name and contact information and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms. If you opt out, any dispute will be resolved exclusively in the state or federal courts located in Laramie County, Wyoming, and you consent to their jurisdiction.

12. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and, if necessary, modified to the minimum extent required to make it enforceable, and the remaining provisions will remain in full force and effect.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the effective date at the top of this page and, for material changes, provide more prominent notice on the Site. Changes apply prospectively; your continued use of the Service after a revision takes effect means you accept the revised Terms. Material changes to Section 11 will not apply to disputes that arose before the change, and a fresh 30-day opt-out window will apply to any materially revised arbitration provision.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may stop using the Service at any time, and text-program subscribers may unsubscribe at any time by replying STOP. Sections 3 and 5 through 12 survive any termination.

15. Miscellaneous

These Terms, together with the Privacy Policy, the Messaging Terms (for subscribers), and any other policies posted on the Site, are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
